Atrum pursues legal claim despite Alberta lifting exploration suspensions

Australia-based Atrum Coal confirmed on Friday that it would continue its legal claim against the Alberta government, despite the Canadian province’s energy regulator lifting suspensions on the company’s coal exploration activities.

The Alberta Energy Regulator (AER) lifted the suspensions in compliance with a new Ministerial Order, which reinstates approvals previously halted under directives issued in 2021 and 2022. The decision allows Atrum and its subsidiary, Elan Coal, to resume exploration activities, including coal exploration programmes, deep drill permits, and geophysical programmes. The expiry dates for these approvals have been extended to account for the period of suspension.

Despite this regulatory shift, Atrum remains committed to pursuing its legal action against the Alberta government. The company has alleged de facto expropriation of Elan Coal’s leases and is seeking monetary compensation on the grounds of private nuisance and unjust enrichment. The case, managed alongside similar claims, is scheduled for trial on April 28 in the Court of King’s Bench of Alberta.
